Chief Justice Dismisses Haynes Application

Criminal figure, Errol Haynes aka “Butchy”, who was handed down a sentence of three years plus fined ten thousand dollars when he did not show up for his drug related trial two years ago, saw his habeas corpus application dismissed this afternoon by the Chief Justice. In May of this year, when he landed in Belize, he was taken straight from the airport to jail on a warrant to serve his jail time.   This week Haynes with the assistance of his attorney, Hubert Elrington, made an application to the court challenging a warrant used to book him to jail. Elrington argued that the warrant is null and void because there is no evidence that Haynes was ever tried. But today, the CJ dismissed his application and advised him to seek judicial review in the matter as an application for habeas corpus was not the route he should have taken having to challenge evidence of his conviction. The Solicitor General’s office submitted that they were in possession of a copy of the magistrate’s court book proving that there is a legal basis to detain Haynes who was tried in abscentia. He was in a jail in Mexico when he was convicted between the period of February twentieth, 2011 and May fourth, 2015. His attorney told News Five that he is planning to take the CJ’s advice for judicial review.
